Terms and Conditions
The Terms and Conditions along with the Privacy Policy form an agreement regulating
our relationship
with regard to the use of Gnet By entering this website you are consenting to the
terms of our
information privacy policy and to our continued use of previously collected
information. By submitting
your personal information to us, you will be treated as having given your permission
for the processing
of your personal data as set out in this policy.
You are advised to regularly check for any amendments or updates to the terms and
conditions from time
to time. Gnet may add to or change or update these Terms of Use, from time to time
entirely at
its own discretion. You are responsible for checking these Terms of Use periodically
to remain in
compliance with these terms. Your use of a Site after any amendment to the Terms of
Use shall constitute
your acceptance of these terms and you also agree to be bound by any such
changes/revisions.
Any clause of terms and conditions if deemed invalid, void or for any reason
unenforceable, shall be deemed severable
and shall not affect the validity and enforceability of the remaining clauses of the
terms and conditions.
Definitions:
"Agreement" means the Terms and Conditions (T&C) contained herein along with the
Privacy Policy
and Terms of Use including other T&C at other portals of Gnet. It will also include
references
to this Agreement as and when amended, notated, supplemented, varied or replaced.
Portal / Site”
means the Gnet platform owned and operated by Gnet. “User/You” means and includes
any Customer / Users / You (the person or any legal entity) who uses the services
offered by
Gnet through its Portal. The agreement between you and Gnet is subject to the
following terms and conditions.
- The User agrees to use the services provided by Gnet, its
affiliates, consultants and
contracted companies, for lawful purposes only.
- Registration: The Registered User agrees and undertakes at
all times to be responsible for
maintaining the confidentiality of the password and user id, and shall be fully
responsible for all
activities that occur by use of such password or user id. Further, the User
agrees not to use any
other party's under ID and Password for any purpose whatsoever regardless of any
authorization from such party.
- The User agrees to: (a) provide true, accurate and complete
information about himself and his
beneficiaries as prompted by the registration form; and (b) maintain and
promptly update the
Registration Data to keep it true, accurate, current and complete. If the User
provides any
- The User agrees to provide authentic and true information.
Gnet reserves the right to
confirm and validate the information and other details provided by the User at
any point of
time. If upon confirmation such User details are found not to be true (wholly or
partly), Gnet has the right in its sole discretion to reject the registration
and debar the User from
using its services without prior intimation whatsoever.
Reservation:
- To seek and/or verify the particulars including financial
information provided by the customer,
either by itself or from independent sources;
- To reject any CAF(Customer Application Form), in case the
particulars provided therein are
incomplete, incorrect or for any other legally just and valid reason. The
information provided by
the customer / gathered by Gnet shall become Gnet’s property even if SAF is
rejected and
Gnet may use the said any lawful purpose, subject to the applicable laws and
regulations.
- To amend the present Terms and conditions for the proper
provisioning of services or to comply
with the applicable laws and regulations.
Services
"Services will be provided within a reasonable time, on receipt of duly completed
CAF(Customer
Application Form), Gnet will use all reasonable endeavors to provide and maintain
services during the
subscription period.
Gnet has the right to predetermine, prefix or re-fix the credit limit for the usage
of Services availed by
the customer based on its internal credit rating. In the event of exceeding of the
credit limit, the
Customer shall be liable to make interim payment forth with for the services availed
including rentals
failing which Gnet reserves the right to totally or partially disconnect/suspend the
services.
Quality, functionally and/or availability of the services, may be affected and Gnet,
without any liability,
whatsoever, is entitled to refuse, limit, suspend, vary or disconnect the services
at anytime, for any
reasonable causes, including, but not limited, to the following:
BILLING & PAYMENTS
- Gnet shall bill the customer as per the billing cycle which
shall run on a frequency as may be
decided by Gnet from time to time. Taxes shall be as per applicable law.
- Customer shall pay the subscription amount in advance as
these are prepaid services.
- No payments are to be made in cash. Only A/c payee crossed
cheque or a bank’s demand draft
is valid.
- Gnet, in accordance with TRAI guidelines/rules/regulations
is entitles to charge, vary, add,
withdraw any services and/or to vary Tariff on these services and/or make any
Service
chargeable which is not initially or at any stage liable for balance, if any.
- To combat potential fraud, sabotage willful destruction,
national security or for any other force
majeure reasons etc.
- Upon delay/non-payment of bills beyond the due date or
non-deposit of charge, or any increase
thereof,Gnet reserves the right to totally or partially disconnect the Services
of such customer.
For restoring the Services, the Customer shall have to apply for restoration
Charges.
- Gnet will not be liable for the Customer equipment being
faulty / incompatible; Customer must
pay all dues in full, without any deduction, set-off or withholding.
- FUP means, Fair usage policy. FUP will be equally
calculated on uploads and downloads.
- Installation Charges will be applicable and May vary on
Area wise.
CANCELLATION AND REFUND POLICY
- In case the customer cancels or disconnects services, the
terms envisaged in the Customer
Registration Form shall apply.
- Refunds, if applicable, at the discretion of Gnet, will
only be made to the customer account
used for the original transaction within 15 working days. For the avoidance of
doubt nothing in this Policy shall require
the Gnet to refund the Price (or part thereof) unless such Price (or part
thereof) have
previously been paid by the customer.
- The Validity, construction and performance of the terms and
conditions of the CAF( Customer
Application Form) shall be governed by and interpreted in accordance with the
laws of Republic
of India. The courts at Bangalore, Karnataka shall have exclusive jurisdiction
in respect of the
subject matter of this CAF( Customer Application Form).
- The parties have fully read and the contents of the terms
and conditions have been explained in
vernacular, Verbatim and upon understanding, have signed the CAF( Customer
Application
Form) as a token of its acceptance/Consent and further with a clear
understanding that it is valid
and binding document on both the parties and can be enforced in the Court of
Law.
